ADR (alternative dispute resolution)

ADR is an alternative procedure of a conflict settlement which is more and more often applied for pre-judicial settlement of economic or other conflicts in a business community. ADR is legislatively confirmed, and the state support of its development shows that it's a perspective and comfortable way of solution of difficult situations which frequently arise in the course of conducting commercial activity.

ADR makes it possible for participants of the conflict to make the mutually advantageous decision independently  at intermediary of the neutral party – a mediator, who  promotes them in compromise search without giving estimations to their positions and actions and without rendering pressure on them.
Important feature of ADR is a possibility of  keeping partner relationships by the arguing parties. It occurs thanks to the mediator helping participants of the conflict to understand a each other's position, to look at a dispute subject on the other hand and as a result to come to the mutually acceptable decision during the consideration of the conflict .
Besides, ADR allows to reduce essentially terms of settlement of disputes and to lower corresponding costs.

ADR principles

ADR assumes observance of such principles, as:
• voluntariness;
• confidentiality;
• equality and equality of the parties;
• a procedure’s transparency;
• responsibility of the parties for the made decision.

Basic ADR-manager’s actions

The ADR-manager guarantees a neutrality and impartiality to all participants of the conflict. Key actions of an ADR-manager are:
• the organization of negotiations;
• assistance to participants of dispute in search of the solution in the hardest problems;
• switching of attention of the arguing parties from personal emotions to consideration of business arguments;
• assistance to the parties in search of common language and creation of atmosphere of mutual understanding in the course of negotiations;
• research of prospects of a mutually advantageous solution of a conflict situation.

The ADR can be organized without personal meeting of participants of the conflict if it's necessary. In that case ADR-manager works  separately with each party until the agreement is reached.
